Hillcrest Cavaliers kennel guarantees this puppy to be free of Genetic Defects until the puppy reaches one year of age. This dog is sold as a companion and is not guaranteed for breeding purposes. Hillcrest Cavaliers kennel also guarantees this puppy to be free of all communicable disease, which we have vaccinated for, for a period of 7 days from date of Sale stated on puppy sales invoice. If this puppy displays any indication of poor health within the first 7 days we must be contacted and the puppy must be taken to a veterinarian for any necessary treatment. Failure to do so will cause this guarantee to become null and void. Also this guarantee shall become null and void if the puppy is given any vaccinations within 7 days of purchase that is not listed “To Do” on their medical record. The OWNERS veterinarian should examine the dog within one week. Owner needs to notify the breeder and return the pup immediately, if practical and in the best interests of the dog. Otherwise, follow directions as to its care. If the new owner’s veterinarian and the breeder’s veterinarian agree that the illness is shown to originate with the breeder, the above guarantee applies and may include payment of the veterinary fees of the breeder. (Parvovirus or Distemper would be examples). The Pup may be returned for a replacement only, as soon as one is available. The warranty set fourth in this contract is the sole warranty and is given in lieu of any and all other warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose. The Owner’s sole remedy is under the warranty provision of this contract and the BREEDER disclaims and will not be liable for any other damages including consequential damages, property damage, emotional distress, loss of use, business interruption or veterinary fees unless specifically set fourth in this warranty provision. As a condition of the sale, the OWNER agrees as follow: 1. The dog will be given a good and loving home. 2. The dog will be given good veterinary care. 3. The OWNER will make all responsible attempts to follow the instructions given for raising the dog. 4. The OWNER will feed the dog a good quality brand of dog food and because of the size of the puppy keep said food available to the puppy 24 hours a day. Breeder will not be responsible for problems that occur from lack of proper nutrition. 5. If the dog is being shipped, the OWNER agrees to pay for the shipping and the veterinary certificate necessary for the shipping. This contract sets fourth the entire agreement between the BREEDER and the OWNER and any inconsistent oral terms have no effect on this contract. REGISTRATION: The formal registration forms will be attained by the purchaser at the time of the exchange. Registering your dog is a good way to show your support for this continuation of the breed, even if you do not intend to breed or show yourself. Registration is best done early.
